Experts Claim That Portland Cement Zambia Is On The Verge Of Collapse, Even After Final Verdict

The case of Portland Cement Zambia was started almost a decade back when Dr. Rajan Lekhraj Mahtani, a noted businessman and philanthropist, registered the case at the Lusaka High Court. Dr. Rajan Mahtani has claimed to be the real and legal owner of the factory and since its establishment, has been leading the factory. The fate of the Portland Cement Zambia has also seen numerous ups and downs with these changes.

During the initial years when Dr. Rajan Mahtani was leading the company, the factory was a huge success. The factory production was surplus and it quickly became one of the biggest producers of cement factories in Zambia. Apart from this accomplishment, the factory quickly became a preferred industrial employer within the province. The above industry average salaries and wages attracted employees and workers from far off places. The contribution of the Portland cement on the country’s revenue and GDP was one of the biggest achievements of the factory.

However, the current condition of the factory can be considered as dangerous and on the verge of collapse. Since the illegal takeover and start of the case at the court, the factory is leaderless. As a result, the management activities are haywire with inconsistent production and irregular salary provisions for the employees and workers. The factory assets have started to corrode and the factory cash box is completely empty. Majority of the workers have started to leave the factory due to non-payment of wages and the revival of the factory is becoming distant dream every passing day.

After ten years of trials, transfer of judges and numerous dramas, the final verdict was announced by the judge residing the case. However, relief to Dr. Mahtani was not given still as the final verdict was given against Dr. Mahtani, despite the evidences. Dr. Mahtani has appealed to the ‘higher court of appeal’ with the hope of reversing this misdirected judgment.

Lusaka High Court’s Announcement On Portland Cement Unjust, Claims Dr. Mahtani

Zambian citizens and corporate houses are still recovering from the shock they received sometime back after the final judgment on Portland Cement Zambia was announced. It was first registered by Dr. Rajan Lekhraj Mahtani, a famous philanthropist, social workers and businessman with more than thirty years of experience within Zambia. The case is about the cement factory which was taken away from Dr. Mahtani.

During the long running trial for over ten years, the case saw numerous changes, especially due to the transfer of judges. This further stretched the timeline of the case as the new judge required more time to go over the case and reach to a respectable position for further arguments and trials. The latest judge overseeing the case made a position announcement few months back by declaring that the case hearing was closed. This meant that the trials and arguments are over and both parties were also asked to submit their evidences in written and oral format. The motive behind this misdirected judgment is unclear and it is still not clear why the judge gave this judgment even when majority of the evidences were clearly indicating that Dr. Mahtani’s claims were valid.

As of now, Dr. Rajan Mahtani has made an appeal to the higher court of appeal against the judgment made at the Lusaka High Court.

Dr. Mahtani has been fighting for the legal takeover of another one of his establishments for the past ten years, Portland Cement Zambia. During these trial years, numerous changes were seen such as transfer of judges and non-availability of the respondents or evidences from their side. However, no judgment was given even though the lawyers from Dr. Mahtani’s end left no stones unturned in securing and providing critical evidences for supporting his claim.

The judge overseeing the case at present, Justice Nkonde, made a positive announcement few months earlier when he stated that in order to speed up the judgment process, the case hearing was over. This meant the judge would not take any more trials. Both parties were asked to submit evidences and testimonials in written as well as oral format. Based on these testimonials and evidences, the justice was supposed to make the final verdict. It was a winning situation for Dr. Mahtani as his evidences were all factual and more prominent than those submitted by the respondents. However, the final verdict announced by the judge was a shocking phenomenon. The judge announced the final verdict against Dr. Mahtani. It was clear that the significant evidences were not even taken into account.

While this judgment is certainly surprising and shocking, Dr. Mahtani has now taken action against this misdirected judgment. An appeal has been made at the higher court of appeal at Zambia wherein Dr. Mahtani has shared details of the event and is awaiting response.
